ENCUESTA de la Comisión Europea a todos los colectivos profesionales europeos sobre la Regulación del ejercicio de las profesiones

La Comisión Europea está realizando una encuesta a todos los colectivos profesionales europeos sobre la Regulación del ejercicio de las profesiones. Considero que todos los profesionales españoles tenemos el derecho a contestarla e incluso creo que es una obligación si es que queremos participar de la configuración de las profesiones en Europa.

Sin embargo existe una dificultad objetiva, como es que la Encuesta pretende la opinión del encuestado sobre el Plan Nacional de Acciones de tu país, pero EL PLAN DE ESPAÑA NO CONSTA COMO PRESENTADO (sobre este particular ya hablaremos una vez vencido el plazo).

La solución es que se puede contestar sobre el PNA de hasta 4 países. Recomendamos Uk, Francia, Alemania y Holanda.

Independientemente de este (lamentable) hecho, reclamo vuestra atención, por su interés estratégico, sobre las acciones que otros países están adoptando sobre el ejercicio profesional de los Arquitectos a los efectos de permitir la libre circulación. Directive 2013/55/EU amending Directive 2005/36/EC on the recognition of professional qualifications (the ‘amending Directive’) had to be transposed into the national law of the Member States by 18 January 2016. The Commission’s main objectives with the amending Directive were to facilitate the mobility of professionals and the intra-EU trade in services, address the challenge of filling high-skill jobs and offer more possibilities for job seekers.

According to recital 35 of the amending Directive, Member States should notify which professions they regulate, for which reasons, and discuss amongst themselves their findings. Such a system would contribute to more transparency in the professional services market.

Article 59 of the amending Directive contains the relevant provisions on transparency and evaluation for regulated professions. Article 59(6) provides that the Member States should communicate the measures taken to the Commission by 18 January 2016 and, subsequently, communicate every two years which requirements have been scrapped or eased. Article 59(7) provides that the Commission shall forward the reports referred to in paragraph 6 to the other Member States which shall submit their observations within six months. Within the same period of six months, the Commission shall consult interested parties, including the professions concerned. This is the purpose of the current Commission consultation. The member states having delivered their National Action Plans to the Commission explaining what they’ve done to facilitate access to the professions (for everyone – national or European), the Commission now wants people’s views on their NAPs and has organised a consultation.
